Successful defense of company in non-compete agreement

Hinckley Allen served as counsel for a regional service provider for construction sites and events. The firm’s client hired an employee who had signed a non-competition agreement with his former employer, a national service provider. The firm successfully defeated a motion for preliminary injunction filed by the former employer against the firm’s client and the new employee. If successful, the motion would have prevented the employee from working with the firm’s client. Hinckley Allen argued that the agreement was no longer enforceable or operative. The Court agreed with the firm’s position for purpose of the motion, and denied the motion for preliminary injunction, ruling in favor of the new employee and the regional construction supply company.
