Public and private owners are increasingly choosing Design-Build as a preferred construction project delivery method. The allocation of risks between an owner, the owner’s designer / engineer, and the Design-Build team, as well as between Design-Build team members (designer / engineer and builder) present issues that do not exist for the more traditional Design-Bid-Build delivery method. In many cases, Design-Build teams are required to lump sum bid Design-Build projects based upon preliminary or incomplete design information. Owners often also demand that Design Build Teams comply with prescriptive specifications even when it later turns out that compliance with such specifications is impractical or impossible. How can companies best protect themselves in the evolving world of Design-Build? What are the key risk factors on Design-Build projects? What are the critical contract terms for Design-Build projects? What are the best practices for Design-Build project management?
