10:15 a.m. – 11:30 a.m.  Raise or Fold: How to Effectively and Efficiently Plan and Prosecute Litigation and Arbitration without Putting the Client on Tilt

The panel discussion will focus on: how to evaluate and underwrite cases, claims, and litigation; how to evaluate and apportion risk; and how to efficiently manage the prosecution and defense of claims.  The presentation will include various claim and project scenarios and an analysis of best practices for the effective management and resolution of clams and disputes.  Best practices will be illustrated by evaluating and applying a dispute and risk analysis decision matrix to mock claims and scenarios.  The program also will explore cost effective strategies and tactics for the resolution of disputes. The session will be executed in three parts.  Part One will present a Dispute Decision Matrix–focusing on essential claim and defense decision points to be considered at the inception of the dispute, and including factual, legal, technical, procedural and business considerations. Part Two will present a Liability Allocation Matrix for the consideration of claims and defenses–focusing on the effective use of insurance, indemnity agreements, surety bonds and third-party actions for the allocation of risk. Part Three will focus on best practices for the efficient and effective management of disputes, including early case assessment and valuation techniques, staffing and budgetary considerations, case management protocols and document, and e-discovery control measures.  With strategic pre-planning and the proper case management protocols, the management of cases of all sizes can be effectively and efficiently managed.

Upon completion of this session, attendees will be able to:


  • Identify compliance tips and best practices to examine cases, claims, and controversies, to manage expense and exposure.
  • Efficiently manage cases, control costs, keep clients informed and involved in case developments, and minimize the risk of unanticipated events and surprises.
  • Identify strategies for evaluating and shifting liability risks.
