Time:

Panel Members: Ronald D. Ciotti, Charlie Rogers and Eric Nelson of Smith Currie, Craig Williams of HKS and a Disney representative

Coghlin Electric Co. v. Gilbane Building raises some fundamental issues that have profound impact of how CM At-Risk works.  Chapters of AGC are pitted on opposite side from chapters of the AIA & ACEC in filed amicus briefs.  Will owners gain protection but face higher contract prices? How this impacts Spearin and design and review responsibility will be explored.  The speakers will dive into legislation proposed to address recent cases as well as how IPD and IPDish projects, which are growing in use, change the analysis.  Also, gain a sneak peek into new IPD standard contracts addressing IPD on issues ranging from limitation of liability, risk pool plans, and warranty.
