Expanding Bid Protests


Construction bid protests fit into several categories: either the low bidder made a “mistake” and wants to withdraw its bid, or the pressure of getting many bids out in a short period of time resulted in carelessness and clerical errors.

A clerical error cannot be a “judgement error,” which will not permit the withdrawal of a bid. Bid protests can be pursued at three levels. First is to pursue it at the local awarding authority and convince them to take action. Second would be to file your protest with the awarding authority and with the Attorney General. The final remedy is to file the protest in court.
