An amendment to the New Hampshire Mechanics Lien Statute (RSA c 447:2) was just signed into law which extends the statutory lien to “professional design services.” Professional design services are defined to include services provided by licensed architects, licensed landscape architects, licensed engineers, permitted septic designers, certified wetland scientists, certified soil scientists and licensed surveyors directly related to the improvement of real property. The statutory process to perfect the lien and the relative priority of the lien for professional design services is the same as existed for the statutory lien for labor and materials. The statutory amendment becomes effective on January 1, 2013.
