Recent Massachusetts Decision Allows Bond Claim for Unused Shop Drawings


Synopsis of article:

Courts interpreting the Massachusetts payment bond statute, M.G.L. c. 149, S 29, have repeatedly emphasized the broadly remedial purpose of the statute to protect subcontractors and suppliers from non-payment. This has led to several decisions allowing recovery for materials supplied and intended for the project, even if the materials were not ultimately incorporated into the project.
