Hinckley Allen Team Fends off $1B False Claims Act Claim

Hinckley Allen client, SYNNEX Corp., a distributor of information technology products, prevailed in a False Claims Act case in which the plaintiff claimed that it violated the Trade Agreements Act when it sold products to the federal government as part of its U.S. General Services Administration contract.  According to the Plaintiff, damages could have approached $1B.

Our attorneys successfully argued that under the False Claim Act’s public disclosure bar, the whistleblower must base his allegations on new information, and that he must show that he is the original source for this information.

The Judge in the case ruled that the plaintiff could not, and granted a summary judgement dismissing the claim.
