Ryan M. Gainor is litigator resolving complex commercial disputes for a diverse array of clients. Ryan is known for his ability to distill complicated facts and legal principles into concepts that help his clients win before juries, judges, and arbitrators.

With deep attention to learning about his clients’ businesses, he works with them to achieve their goals. His recent successes include obtaining a complete victory on behalf of a Fortune 50 company in a $10 million commercial arbitration and overturning a lower court judgment on behalf of two tax clients before the Rhode Island Supreme Court. He also won summary judgment on behalf of a client in a complex constitutional case concerning the interplay between the Dormant Commerce Clause and the 21st Amendment. Finally, as part of a Hinckley Allen team, he won a significant victory in the federal trial court and the First Circuit Court of Appeals involving the copyright authorship of the iconic Game of Life.

An astute and tireless advocate, Ryan represents clients in all phases of litigation including pre-litigation dispute resolution, motion practice, summary judgment, mediation, trial, and appeals. Clients particularly appreciate his advice as they respond to high-stakes situations, finding the most efficient solution to achieve goals, while causing the least distraction to ongoing business operations.

Ryan tries cases in state and federal courts, successfully arguing before the Rhode Island Supreme Court, the Rhode Island Superior Court, the United States District Court for the District of Rhode Island, the United States District Court for the Southern District of New York, the United States Court of Appeals for the First Circuit. His experience includes bringing matters to final arbitration hearings before both AAA and JAMS.

Before joining Hinckley Allen, Ryan was an associate with a major international law firm in New York where he established the foundation for his thriving litigation practice.

  • Obtained an arbitral decision on all counts for a Fortune 50 Company, where claimant sought more than $10 million.
  • Successfully argued two appeals on behalf of tax clients before the Rhode Island Supreme Court leading to the reversal of lower court decisions.
  • Obtained summary judgment on behalf of a client of a federal False Claims Act case seeking more than $100 million in damages.
