Successful outcome for distributor in claim of alleged tire defect

Hinckley Allen represented Dynamic Tire Corporation, a distributor of various types of tires in North America, in a lawsuit filed in the United States District Court for the Central District of California where the plaintiffs alleged that certain special trailer tires contained both design and manufacturing defects.  The plaintiffs sought nationwide class certification as well as class certification in California, Arizona, Colorado, and Florida.  The Court denied class certification on a nationwide basis and state putative classes in Arizona, California, and Colorado.  On January 29, 2019, the Court granted summary judgment in favor of Dynamic Tire finding that plaintiffs did not provide support for their claims of a design or manufacturing defect in the special trailer tires.  Hinckley Allen partner, Mitchell Edwards, led the Hinckley Allen team in the firm’s representation of Dynamic Tire Corporation in this matter.
