Jeff D. Bernarducci, partner in the Construction & Public Contracts Group, will be a featured speaker at the Massachusetts Lawyers Weekly panel, “What the SJC’s Prompt Payment Decision Means for Businesses.” From Massachusetts Lawyers Weekly:
In J.C. Cannistraro, LLC v. Columbia Construction Co., the Supreme Judicial Court held that an arbitrator had not exceeded their authority in allowing a general contractor to recoup overpayments from a subcontractor, even though the contractor originally failed to comply with the Prompt Pay Act’s good-faith invoice rejection requirements.
Our expert panel will discuss the underlying litigation, the court’s reasoning, and what this means for businesses going forward.
