In J.C. Cannistraro, LLC v. Columbia Construction Co., the Supreme Judicial Court held that an arbitrator did not exceed his authority or violate the Massachusetts Prompt Pay Act by allowing a general contractor to assert counterclaims to recover payments previously made on subcontractor invoices – pursuant to the arbitrator’s interim award – even though the contractor did not make the payments prior to asserting its defenses as required under Business Interiors Floor Covering Business Trust v. Graycor Constr. Co., 494 Mass. 216 (2024).
