The U.S. Supreme Court has finally resolved a sharp circuit split about the scope of the Computer Fraud and Abuse Act, 18 U.S.C. § 1030 (“CFAA”), a case with significant implications for criminal defense and employment attorneys alike. The question presented was whether a person who is authorized to access information on a computer for certain purposes violates Section 1030(a)(2) of the CFAA if he accesses the information for an improper purpose. Put another way, can the statute – which has civil and criminal components – be used only against traditional “hackers,” or can individuals be pursued criminally and civilly for using their authorized access for an unauthorized purpose. Our panel will give you the defense and government perspectives on this much-awaited decision.
