Jennifer McCabe, Brian Albert, Colin Albert, and Brian Higgins filed a 14-count lawsuit against Karen Read and Aidan Kearney in Barnstable County Superior Court under Massachusetts state law seeking damages for defamation, conspiracy, and intentional infliction of emotional distress.

Tuxbury and Murphy have been serving as counsel for Jennifer and Matthew McCabe, Nicole and Brian Albert, and Brian Higgins in a civil lawsuit brought by Read in November 2025, which is currently pending in Massachusetts federal court.
