Alexandra is a Partner in Hinckley Allen’s Construction & Public Contracts and Senior Living groups. She concentrates her practice in the areas of construction, complex commercial litigation, and insurance.

Alexandra represents clients on matters ranging from general construction and construction-related claims to complex Consumer Protection Act cases, including those arising out of allegations of unfair and deceptive acts under G.L. c. 93A and R.S.A. 358-A. She has represented clients in matters involving building code violations, negligent design and construction claims, breaches of the implied warranty of habitability, breaches of contract, DBE investigations, violations of the Prompt Pay Act, wrongful termination claims, bid protests, and products liability claims. She works with clients in various industries, including sewage, commercial contracting, vertical and horizontal construction, and residential construction.

Alexandra regularly counsels clients on matters of insurance coverage and best practices for insuring compliance with Federal guidelines for Disadvantaged Business Enterprises (DBEs) and the Massachusetts Prompt Pay Act.

Alexandra has successfully represented clients in multiple jury and jury-waived trials in the Superior Court and before panels of arbitrators. She has also drafted appellate briefs to the Massachusetts Court of Appeals, the Supreme Judicial Court of Massachusetts, and the U.S. Court of Appeals for the First Circuit.

Experience

  • Successfully negotiated settlement in case of non-payment due to a business email compromise incident. Demonstrated that even though our client’s systems were hacked, they had reasonable measures in place to prevent hacking.
  • Obtained defense verdict on behalf of long-term care facility following three-week medical malpractice trial in Massachusetts Superior Court.
  • Obtained defense verdict on behalf of automobile driver following week-long negligence and complex damages trial in Massachusetts Superior Court.
  • Obtained summary judgment in negligence action against multi-national hotel chain in U.S. District Court for the District of Massachusetts by application of out-of-state statute of limitations.  Susan Gordon v. Starwood Hotels and Resorts Worldwide, Inc., No. 15-13289-MBB, 2017 WL 841275 (D. Mass. Mar. 3, 2017).
  • Drafted successful appellate brief upholding grant of summary judgment on a negligent entrustment claim, affirmed in a full opinion.
  • In issue of first impression for Rhode Island, defeated motion to dismiss and motion for summary judgment in the Business Session of the Superior Court arguing that an expired employment agreement satisfied the statute of frauds.
  • Obtained favorable decision on behalf of general contractor arising from claim of wrongful termination following four-week arbitration.
  • Obtained favorable verdict on behalf of general contractor arising from claim of breach of contract and non-payment following three-week trial.
  • Drafted successful appellate brief reversing jury verdict and finding that a private sale of a home outside the scope of the Massachusetts Consumer Protection Act.  Sullivan v. Gagliardi, 487 Mass. 64 (2021).
