Michelle R. Peirce, partner in the Litigation Practice and co-chair of the White-Collar Crime & Government Enforcement Group, discussed the anticipated uptick in white-collar prosecutions under Leah B. Foley, the new United States Attorney for the District of Massachusetts, with Law360.
In the discussion, Michelle highlighted that U.S. Attorney Foley will likely prioritize healthcare fraud:
“She acknowledged Boston’s historic role and place in combating healthcare fraud and investigating it,” Peirce said. She added that is consistent with a May 14 memo from the U.S. Department of Justice outlining white-collar priorities for the administration, which specifically highlighted “waste, fraud and abuse, which will include health care and federal program procurement fraud.”
Additionally, Michelle commented that staffing levels are likely a potential challenge:
“You can’t have all these departures at the federal level and not have it impact all federal enforcement,” she said. “A lot of resources have shifted to immigration-related work. To the extent that you are moving people to help with immigration, you’re going to have fewer people working in other areas.”
