Hinckley Allen represented the City of Salem, Massachusetts (the “City of Salem”) in connection with the Salem Offshore Wind Terminal (the “Project”), a public-private partnership between Crowley Wind Services (“Crowley”), the Massachusetts Clean Energy Center (“MassCEC”) and the City of Salem. The Project represents a large step in both the Commonwealth’s and City of Salem’s long-term commitment to the growth of renewable offshore wind energy.
As part of the transaction, MassCEC purchased more than 42 acres of land on Salem Harbor, subsequently transferring 5 acres, including the port’s existing deep-water berth, to the City of Salem who then leased the 5 acre parcel back to MassCEC pursuant to a long-term ground lease. In addition, the City of Salem and Crowley agreed to a Community Benefits Agreement (“CBA”) which provides for the funding of nearly $9 million to the Salem community.
Our attorneys provided legal counsel to the City of Salem regarding several different aspects of the Project, including the negotiation of a ground lease, real estate closing documents, the CBA, a wharfing rights agreements and various other documents.
The Project promises to provide both short and long term benefits for both the City of Salem and Commonwealth of Massachusetts alike and we are proud to have played a part.
