Edward “Ned” Sackman

Ned Sackman is a commercial litigator who resolves complex, high-value disputes, with a focus on intellectual property matters and a long history of representing auto and equipment dealers. Known for taking on problems that significantly impact businesses, Ned applies clear strategies and unshakable advocacy for companies.

In his commercial litigation practice, Ned regularly defends companies in contract matters, business torts, restrictive covenant disputes, and business divorces. Ned also works with auto and equipment dealers on franchise termination protests, add point disputes, and consumer litigation. In the area of intellectual property, Ned advises on trademark, copyright, and trade secret litigation, including frequent matters before the Trademark Trial and Appeal Board.

Ned is an active member of the American Intellectual Property Law Association (AIPLA), where he currently serves as Chair of the Copyright Law Committee.   In that role, he assist in interfacing between the AIPLA and the U.S. Copyright Office, and organizes regular presentations on cutting edge copyright law issues, including the intersection of copyright law and artificial intelligence, and the impact of recent Supreme Court decisions, such as Cox Communications, Inc. v. Sony Music Entertainment, Andy Warhol Foundation for the Visual Arts, Inc. v. Goldsmith, and Warner Chappell Music, Inc. v. Nealy.

Ned also stays current on developments in the automotive and equipment dealer law space through memberships in the National Association of Dealer Counsel, New Hampshire Automobile Dealers Association, and Massachusetts Automobile Dealers Association.  He is currently monitoring several FTC enforcement actions, as well as tracking the most recent M.G.L. Chapter 93A decisions in Massachusetts state and federal court.

In addition to his robust law practice, Ned believes it is important to support his community.  He has represented clients on a pro bono basis throughout his career, including a long representation of New Hampshire’s only inmate on death row in post-conviction proceedings seeking to vacate his capital sentence.  Ned also serves on the Leadership Council for the Campaign for Legal Services, which helps raise money for New Hampshire’s two civil legal aid organizations—New Hampshire Legal Assistance and 603 Legal.

Commercial Litigation

  • Obtained preliminary injunction for one of New Hampshire’s largest hospitals prohibiting the State of New Hampshire’s recoupment of millions of dollars in Medicaid funding. Concord Hosp., Inc. v. NH Dep’t of Health & Hum. Servs., 743 F. Supp. 3d 325 (D.N.H. 2024).
  • Obtained summary judgment in favor of large New Hampshire-based bank in major breach of contract litigation.
  • Defended global insurance broker against seven figure M.G.L. Chapter 93A unfair and deceptive practices claim.

Intellectual Property

  • Represented national musical equipment retailer in jury trial before New Hampshire federal district court arising from copyright and trademark infringement claims.
  • Successfully opposed trademark registration requests in inter partes proceedings before the Trademark Trial and Appeal Board for national ski and snow apparel . See, e.g., Ridestore Holding AB v. GXG International, LLC, 2024 WL 4925839 (T.T.A.B. 2024).
  • Defeated preliminary injunction request against financial services firm based on alleged breach of non-competition agreements and trade secrets misappropriation.

Auto and Equipment Dealers

  • Part of trial team that defeated international agricultural equipment manufacturer’s attempt to modify performance standards for local dealership.
  • Ongoing defense of consumer claims on behalf of Fortune 500 company operating approximately 30 auto dealerships in New England.
