Under New Hampshire law, if, as a result of a tenant default, a landlord seeks to collect damages from the tenant, then the landlord has a duty to mitigate its damages. New Hampshire case law does not provide significant guidance as to what that duty entails under a variety of specific circumstances, but in general the duty requires a landlord to use reasonable efforts to minimize its loss, including using reasonable efforts to relet the premises on commercially reasonable terms.
