Damien C. Powell is a partner with the Litigation Group at Hinckley Allen. He has built a career successfully representing healthcare and academic institutions, providers, physicians, scientists, researchers, and faculty members in high-stakes investigations and cases involving wide-ranging federal and state claims. As one of the Best Lawyers in America® in Criminal Defense: White-Collar and recognized in Super Lawyers® for Massachusetts, Damien is known for his representation of clients in complex civil and white-collar criminal actions at every stage of litigation.
Damien’s work has won millions of dollars in awards in cases before state and federal courts and administrative agencies. He has successfully defended numerous health care entities and individuals in federal and state False Claims Act investigations. His ability to craft powerful, nuanced arguments has persuaded government agencies not to sanction clients, and has persuaded state and federal prosecutors not to bring charges.
Damien serves as the Chair of the firm’s Research Compliance & Integrity Practice Group and regularly represents academic researchers and institutions in matters involving allegations of research misconduct (fabrication, falsification, plagiarism), financial conflicts of interest, and workplace harassment and bullying. Damien has also successfully defended numerous faculty members, and college and graduate students in cases involving Title IX, as well as cases arising out of allegations of plagiarism, bullying, and hazing.
Damien’s extensive experience also includes the niche realm of alcohol law. He drafted and mounted challenges to different Massachusetts ballot questions and has successfully represented clients in the alcohol industry in civil litigation, licensing matters, and government investigations.
A seasoned and highly skilled trial attorney, Damien has appeared before numerous courts and spearheaded countless internal investigations.
Damien is also a committed and passionate volunteer, serving on the Board of Directors of MetroWest Legal Services and formerly serving as Guardian ad Litem in the Suffolk Juvenile Court.
