Understanding and Complying with Set Aside Goals – DBE – MBE – WBE

The Program will present an overview of the current programs requiring the participation of MBE, WBE, and DBE entities in public construction projects within Massachusetts.  Initial discussion will summarize the current “legal” challenges to these programs and what changes, if any, are likely to occur in the upcoming court decisions.

The primary focus of the program is to familiarize the attendees with what is currently required to be submitted, by whom, and when in order to qualify for the award of a contract then successfully fulfill the goal for the project as well as a discussion as to the role of subcontractors.  The steps needed to request a waiver if the percentages goal cannot be met will also be reviewed.

The final part will focus on the problems that may confront a contractor for non-compliance.  What sanctions are available and what sanction can and have been imposed on a contractor for a violation or failure to achieve the goal?  How can a contractor avoid such problems?
