Internal investigations raise a variety of complicated ethical and legal considerations. Our panelists will tackle some of the most common issues, pitfalls and questions that arise when counsel leads an internal investigation in the wake of a government investigation. Attendees will walk through hypotheticals that implicate complex issues, including but not limited to attorney-client privilege, scope of representations for organization vs. individuals, communication with and discovery requests from the government. Specifically, the program will address (1) How to guide a company through an internal investigation after receiving a CID/subpoena from the government; and (2) How to navigate parallel criminal and civil proceedings, including between different government agencies.
