Janelle Pelli is an associate with the Litigation group at Hinckley Allen who represents clients in civil commercial litigation across the country. Janelle sits in our Albany, New York office. Janelle’s client’s include companies and individuals in construction, healthcare, banking, securities, government, research institutions, and private businesses.

Janelle is a member of our Labor & Employment Practice Group, frequently handling matters brought under Title VII, the Sarbanes-Oxley Act, the Americans with Disabilities Act, the New York State Human Rights Law, and the New York City Human Rights Law, as well as disputes concerning employment agreements, non-competes, cybersecurity, discrimination, and NLRB claims. Janelle is also experienced in white-collar defense and investigations, and has skillfully represented clients in investigations by state and federal agencies, including in financial crimes and claims brought under the False Claims Act.

As a valued member of the litigation team, Janelle leverages her knowledge of the law and her cases to effectively represent clients. Her advocacy and collaborative approach provide essential support to clients in their time of need.

Janelle is admitted to practice in New York and before the United States Court of Federal Claims and the United States District Court for the Eastern, Northern, and Southern Districts of New York. Her vast knowledge and experience helps to ensure her clients receive exceptional representation in their legal matters.

Before joining Hinckley Allen, Janelle served as a law clerk for the Honorable Mae D’Agostino in the Northern District of New York, where she provided invaluable support in civil and criminal cases.

Janelle’s commitment to the upstate New York legal community extends to her role as the former President of the Adirondack Women’s Bar Association, a chapter of the Women’s Bar Association of the State of New York, and a current member of the board. She also serves as co-chair of the Equal Opportunity in the Profession committee for the Women’s Bar Association of the State of New York. Janelle is a member of the CLE committee and First Decade committee of the Federal Court Bar Association – Northern District of New York chapter and has moderated several CLEs in upstate New York. She also volunteers her time with Adirondack Women’s Bar Association’s monthly domestic violence legal clinic and The Legal Project’s immigration clinic.

Janelle serves on the Lake George Land Conservancy’s NextGeneration Committee, a volunteer group of individuals who are passionate about protecting and preserving the lake, land, and surrounding communities.

Experience

Civil Commercial Litigation:

  • Representing the former CEO of a publicly-traded renewable energy company in the largest Sarbanes-Oxley whistleblower retaliation claim.
  • Representing large fossil fuel company against nuisance litigation brought by the State of Rhode Island.
  • Frequent representation of businesses and individuals in business disputes, breach of contract, and business tort actions in lawsuits across the country and in New York State.
  • Serving as local counsel in business dispute involving non-compete agreement entered into as part of the sale of a business with a New York choice of law and forum selection clause.
  • Successfully defended Rule 60(b) motion brought by an investment advisor.
  • Representing international company in a COVID-19-related dispute under the force majeure clause of an agreement.

Labor & Employment:

  • Representing client in securities industry in Sarbanes-Oxley whistleblower retaliation claim before OSHA against former employer.
  • Successfully represents clients against discrimination claims brought under Title VII and state law discrimination statutes.
  • Regularly advises and represents employers in connection with employee disputes, including disputes over confidential information, employment agreements, and non-competes.
  • Successfully resolves claims brought under the Americans with Disabilities Act, the New York State Human Rights Law, and New York City Human Rights Law in New York federal courts against clients alleging barriers to access in places of public accommodation.
  • Regularly advises clients on cybersecurity matters affecting employers.
  • Represented local Albany businessman and his company in dispute with the client’s former employer over non-compete in his employment agreement.

White Collar, Government Enforcement & Internal Investigations:

  • Successful representation of a health care executive to favorable settlement in defense of False Claims Act claims resulting in dismissal of civil claims and federal prosecutors declining prosecution.
  • Successful representation of businessman through plea and sentencing in connection with numerous financial crimes.
  • Advises professionals regarding civil and criminal exposure in government investigations, claims, and prosecutions.
  • Conducted internal investigation on behalf of a non-profit Board of Directors regarding sexual misconduct allegations against a Board member.
  • Successfully conducted an extensive internal investigation into the research and grant recipient arm of a private company arising out of whistleblower allegations of mismanagement and harassment, and advised client on same.

Construction Litigation:

  • Won summary judgment before the Court of Federal Claims on a wrongful termination claim in connection with unique federal contract on behalf of energy client.
  • Routinely advises and represents developers, general contractors, project managers, and government entities in construction, insurance, leasing, and other contract disputes against private and government entities.
  • Assists clients in subpoena responses and responding to third-party discovery demands.
  • Frequently represents contractors in civil litigation against project owners, other contractors, and/or subcontractors across New York state.

Health Care:

  • Frequently advises and represents doctors and nurses in investigations by state regulatory bodies, resulting in many closed investigations without disciplinary actions taken against clients.
  • Representing a medical practice against its former medical malpractice carrier in claims for misrepresentation and breach of fiduciary duty.

Banking & Financial Services:

  • Representing a regional bank against claims arising from fraudulent conduct against a customer’s account by third party.
  • Routinely advises banking clients on issues of New York law, including consumer protections for banking customers and bank responses to subpoenas.
  • Regularly advises regional banks on compliance and litigation matters.
