Policy, Practical, and Legal Challenges to Inclusionary Zoning


Timothy S. Hollister, Andrea L. Gomes, and Scott R. MacNeil prepared the latest resource manual, “Policy, Practical, and Legal Challenges to Inclusionary Zoning: A Resource Manual for NAHB Members,” on inclusionary zoning for National Association of Home Builders (NAHB) Members.

In the manual, Hollister, Gomes, and MacNeil include a list of policy, practical, and legal strategies that NAHB members may adopt when dealing with inclusionary zoning proposals. Additionally, the resource includes an accessible guide to state statutory and case law authority for municipal or county governments to enact inclusionary zoning ordinances.

With little statutory authority and case law guidance on inclusionary zoning, Hollister, Gomes, and MacNeil state “…the best strategy for NAHB and its members who are confronted with a proposed inclusionary zoning program and want to challenge it, is to challenge proactively the practicality, feasibility, and effectiveness of the proposed program.”
